Firm Obtains $100,000 Lien Judgment

A client of the Firm brought an action against several defendants relating to a multimillion dollar data center upgrade at the IBM campus in Research Triangle Park.

Lee Robertson, an attorney in the Firm’s construction litigation group obtained a judgment for breach of contract, unjust enrichment and foreclosure on a claim of lien on funds for $112,662.61, plus attorneys’ fees of more than $6,000.

North Carolina law strictly enforces a 120-day deadline to file a claim of lien on real property and a 180-day deadline to bring suit to foreclose the lien. Failure to adhere to these deadlines can be fatal to a subcontractor’s ability to foreclose a lien on real property.
